By creating an account, accessing, or using Carespottr ("Platform," "Service," "we," "us," or "our"), you agree to:

If you are using Carespottr on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Service Description

Carespottr provides:

  • Directory Services: A searchable database of disability service providers in San Diego and Riverside counties
  • Connection Platform: Tools to facilitate contact between families and providers
  • Information Sharing: Reviews, ratings, and provider information
  • Appointment Management: Booking and scheduling functionality
  • Community Resources: Events, blog content, and educational materials
3. User Accounts and Responsibilities

Account Creation:

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining account confidentiality
  • You must be at least 18 years old to create an account
  • One person or entity per account

Account Security:

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account

User Conduct:

You agree NOT to:

  • Provide false or misleading information
  • Impersonate others or misrepresent affiliations
  • Violate any laws, regulations, or third-party rights
  • Upload viruses, malware, or malicious code
  • Harass, abuse, or harm other users
  • Scrape, copy, or use automated systems to access the platform
  • Attempt to gain unauthorized access to systems or data
4. Provider-Specific Terms

Provider Requirements:

  • Maintain current, valid professional licenses and credentials
  • Provide accurate information about services and availability
  • Respond to inquiries in a timely and professional manner
  • Comply with all applicable healthcare regulations (HIPAA, state laws)
  • Update profile information when circumstances change

Verification:

Carespottr reviews provider credentials but does not guarantee accuracy or completeness. Families should conduct their own due diligence before engaging services.

5. User-Generated Content and Reviews

Your Content:

By submitting content (reviews, comments, messages), you grant Carespottr a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on the platform.

Review Guidelines:

  • Reviews must be based on genuine experience
  • Be honest, fair, and constructive
  • Do not include personal health information (PHI)
  • No profanity, hate speech, or discriminatory language
  • No promotional or commercial content

Moderation:

We reserve the right to remove, edit, or reject any content that violates these terms or community standards. We are not responsible for user-generated content.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy and HIPAA Compliance Statement to understand how we collect, use, and protect your information.

By using Carespottr, you consent to data collection and processing as described in our Privacy Policy.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The service will be uninterrupted, secure, or error-free
  • Provider information is accurate, complete, or current
  • Results from using the platform will meet your expectations
  • Provider services will meet your needs or quality standards

YOU ASSUME ALL RISKS ASSOCIATED WITH USING THE PLATFORM AND ENGAGING WITH PROVIDERS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Carespottr is not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not responsible for provider actions, services, or outcomes
  • Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater
  • This limitation applies to all claims, whether based on contract, tort, or any other legal theory

Some jurisdictions do not allow limitation of certain damages, so this may not fully apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Carespottr, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or conduct
  • Interactions with other users or providers
10. Termination

By You:

You may terminate your account at any time through account settings or by contacting us.

By Us:

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Harm other users or the platform
  • Fail to maintain required credentials (providers)

Upon termination, your right to use the platform ceases immediately. We may retain certain data as required by law or legitimate business purposes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Dispute Resolution:

  • First, attempt informal resolution by contacting us at carespottr@gmail.com
  • If unresolved, disputes shall be resolved through binding arbitration in San Diego County, California
  • You waive the right to participate in class action lawsuits
12. Changes to Terms

We may update these Terms to reflect:

  • Changes in platform features or services
  • Legal or regulatory requirements
  • Improved clarity or user protection

We will notify you of material changes via email or platform notice. Continued use after changes constitutes acceptance.
